office

my lawyer did not tell me that one of her employees is friends with my exwife involving a custody issue and now are name is coming up on a witness list

The attorney would not necessarily have known that your ex wife is friends with one of the attorney's employees. You need to meet with the attorney and explain your concerns and ask how this will be handled. It is up to the attorney to keep any information regarding your case away from this employee and, if the employee should happen to become aware of any information, he is under a duty not to discuss this at all with your ex wife or to divulge any information from your file. If you are uncomfortable with this set of facts, then you should consider hiring a different attorney.
