Legal Question in Bankruptcy in Florida

Is it possible to be able to file for a Ch. 7 Bankruptcy in only three days before a foreclosure Trial?

Isn't there an online course that is required?

Thank you!

Yes, and yes. The problem is that you will have to pay money in order to get that done. The filing fee alone is $335. And the first course can cost $25 but you have to have it from an approved source.

Yes it is possible. The course only takes two hours so you can do it this afternoon. If you can't get the certificate immediately for some reason you can indicate on the paperwork that you have completed the course but don't have the certificate yet. http://www.abc27talkback.com

You need more info than what has been provided here. For one, a chap 7 won't help you keep your home. It would temporarily stop the foreclosure, but the lender's atty. can file a motion to continue it. A chap. 13 will allow you to keep your home.

You can file it any time prior to the sale date for the home. That means you don't have to file it before the trial. they could even have a judgment of foreclosure....as long as a BR is filed prior to the sale date, it can be stopped.

There is a required counseling class to take prior to filing...it can bee taken on-line.

Let me know if my office can be of any assistance in No. Fla.
