Legal Question in Bankruptcy in Florida

Filing bankruptcy in different county

My parents need to file bankruptcy. My question is do they have to file in their county or can they do it with a lawyer in my county. Also my dad is in a nursing home as of a year ago. Can he be included without having to attend any of the appointments?

Hello:

I just read your question. While I have not researched the issue of which venue is appropriate for filing in a while, I believe one has to live in that jurisdiction for at least 6 mos. before filing there.

Also, if your father's health is poor and prevents him from traveling much outside his home, you can ask (file a motion) the Court to excuse him from the creditors' meeting. He may be able to satisfy some of the counseling requiremants from his home or he may ask to be excused from those if his wife will be attending. I have not had that issue come up since those requirements were instituted. Good luck. tom rosenblum
