Legal Question in Business Law in Florida

concession stand contract

we run a concession stand for the city of newberry.

we have a contract which states a 90 day written notice termination by either party.

this contract was arranged by the previous owners of our business, there is a statement in the contract that says if the business sells the contract is still valid with new owners(ie us).

the city of newberry have informed me yesterday by email that our contract with them will end on april 10th this year.

they say an improvment notice they gave us 3 months ago was our notice.

obviously we are now unable to sell existing stock and losing next 3 months profits, due to the lack of notice.

have we got a case against them??

Re: concession stand contract

It would depend entirely upon what the "improvement notice" says and whether it gave proper notice under the contract.

Re: concession stand contract

I would need to read the contract and notice from the city to know your options. Feel free to contact me directly.
