Legal Question in Business Law in Florida

Can someone sue me on Ebay for false advertising if I had the item but couldn't find it? I sent them a full refund.

As a Franchise Attorney I can say this. Anyone can sue anybody for anything. The big question is will they prevail and at what cost. And what are their damages if you gave them a full refund anyway? Consult with a good business or franchise attorney in your area for specific advice.
