There is a Florida law that allows an employee to recover damages including emotional distress from an employer that fires him due to his seeking workers compensation benefits. As to pain and suffering from the injury, that would be limited to what you can get for your workers compensation injury. If you don't have a workers compensation lawyer, your husband should get one. If you need more information on the workers compensation retaliation laws, feel free to check out our employee rights blog www.takethisjobnshoveitblog.com or www.behrenlaw.com.
