Legal Question in Technology Law in Florida

Annonymous Public Message Boards

I have been reading a public forum for awhile now and would like to know precisely the truth on certain issues regarding some members threatening lawsuits against others. On this message board, everyone uses a User ID. Member also have a choice as to ingore members or not. Recently one member has posted to people that argue with her that she is filing lawsuits against the members that don't agree with her or argue with her. From what Ive read, this very same person who is posting these threats to other members has not only participated in the same manner as those she is accussing, but she has also been the creator of many threads that have insulted members and have been racist. I think its just catty arguments and this member is using scare tactic and intimidation by threatening these other members with lawsuits. Everyone on that public board argues and some call names. How much truth is it in this members posts to others about filing suits and in contact with lawyers about what she calls defamation and libel which she has pretty much behaved this same way?

Re: Annonymous Public Message Boards

You can't sue for racism or racist statements. Defamation requires that the writer actually cause monetary harm to the person they defame (with four exceptions that probably don't apply here), and that the writer not be speaking the truth.

It's very, very doubtful that anyone can sue for what's been said on the forum, but if you were more specific, I could probably answer your question better.
