Whether it's legal to provide (or use) this type of service depends on the laws of the jurisdiction where the customer and/or the service are located, and on the facts of any given case. Even where doing so doesn't violate any laws, it typically will violate the school's code of conduct. Where the school has a contract with the student (as colleges, trade schools, etc. almost always do) or with her parents (as private primary or secondary schools do), such cheating typically amounts to a breach of the contract.

You say this is a "difficult moral debate." But a debate can only be difficult if there are reasonable arguments on both sides. There is no reasonable argument that students should be allowed to pay someone else to do their homework.

When a student hands in an assignment, she is holding it out as her own work. If someone else actually did the work, then the student is cheating. She's trying to get a grade -- and, ultimately, a diploma, certificate, or degree -- without earning it. That's dishonest and unethical. It's also grossly unfair to other students who actually are doing the work. Many schools and colleges expressly forbid students to hand in other people's work as if it were their own, and many impose serious penalties when this happens -- up to and including expulsion.
