Legal Question in Construction Law in Florida

Ground Breaking

I signed a contract for a new townhouse back in March, there is no start date in the contract, is there a law that states the building company must break ground within a certain time frame regardless of contract, if so can you supply me with the information to obtain a written copy of this law so I can retreive my deposit

Re: Ground Breaking

There is no law in Florida that requires the builder to "break ground" within a certain time. Most real estate contracts of the type you have, however, usually contain a closing date or provide a time frame for completion of the house. Of course, an attorney would need to review your specific contract in order to give you a definite answer on that. If it appears the builder is not going to start building in sufficient time to deliver your unit within the time frame provided by the contract, then it is certainly appropriate to bring your concern to the builder's attention, and discuss the return of your deposit, if that is what you want. If there have been construction delays, then the terms of your contract will need to be reviewed to determine what rights you may have under the contract. These types of matters are largely governed by contract instead of statutes. If I can be of assistance, please do not hesistate to contact me.
