Legal Question in Construction Law in Florida

My ex owns a condo in Ponte Vedra Beach. I renovated it and work was completed in October 2007. My contractor did a horrendous job and I refused to pay him what he claims is $15,000, the last payment of a $220,000+ job. He placed a lien on the condo in October of 2008. My question is: As the law states a lien cannot be placed after 90 days from completion. How can I, what legal instrument can I use, to remove this lien.

You are correct. A lien must be filed within 90 of the last date work is done on the project. Also, a lien is only valid for 1 year in florida. To have it removed you must petition the court. I would recommend you read FL Statutes Sections 713.22 thru 713.31. Also note, in cases where the lien is filed too late or fraudulently filed, you maybe able to get your attorney's fees paid by the contractor who filed the lien.
