Legal Question in Consumer Law in Florida

I just asked this question and received this answer I have a new question the claim of exemption you said they will mail me is this the same as a fact information sheet asking personal questions about bank accounts and jobs. they sent that to me with the judgement and want me to return it to the court and who is suing me. Also the car is financed and we owe more then it is worth. My husband was not on this account it was just mine so can they hold him responsible .

07/23/09, 5:24 pmAnswer (1 of 1) They cannot garnish your ss. If the bank account is held by the entirerties, then they cannot take it; but only joint, they can. Check with your bank. They cannot take the home if it is homestead. THIS IS VERY IMPORTANT:you will receive Claim of Exemption and Request for Hearing. You MUST FILL THIS OUT AND SENT IT BACK WITHIN 2O DAYS OF RECEIVING IT OR YOU WAIVE ALL YOUR RIGHTS, EVEN AS TO HOMESTEAD. Whether they can take the car depends on many things which you do not list, such as the value of the car.

I cannot tell without seeing it. If it is called "interrogatories" and requires you to answer in 30 days as oppossed to 20, then no. Nevertheless, you should answer the questions timely.
