Asset Acceptance

They have sued me on two accounts.

Both are time barred as they have

ignored my request for over 30 days

to send me proof of payment. This is

a common scam for them. I want to

ask for dismissal prior to a trial date

being set and need to know how to

do this. It is my understanding that if

they do not provide the documents I

asked for then I can ask for a

dismissal. I'd rather end this earlier

than have to wait for trial dates on

both of them. I can't afford an

attorney, obviously. Thanks for your

help in advance!

You need to ask for the documents in writing and as a formal "request to produce." Then move for summary judgment. Set a hearing for at least 20 days off. Filke any evidence you have and an affidavit that you do not owe the debt, which I assume is correct. If you did owe it and the statute of limitations has expired, you will not need the affidait of no debt.
