Used Car Purchase

My Husband and I are attempting to purchase an upgraded used car from a local car lot. We submitted our older vehicle plus a check for one thousand dollars as a deposit. We were given the new car to take home but our financing was still pending. We have had the vehicle for 2 weeks but it appears our financing is not going through. Now car lot owners either want the car back ( we understand that) or or total cost of the newer vehicle. They stated that we cannot get our money back and they have sold our other car at an auction. We have driven their car three times and it is housed in our garage. They can check the mileage and see that we've really NOT gone anywhere with it. They have sold our other car at an auction. Is it the law that they can keep both our car and our money?

The answer to your question depends on what is in your contract with the dealership. Read it. It will tell you what your rights and responsibilities are.
