check for two

Can I deposit a check written out to me and another person in my individual account? If I sign just my name on the back and my bank allows it and the other person who the check is written out to, finds out, am I in any legal trouble? Can they have me arrested? What can the other person do to me? If I don't forge their name, is this a crime depositing the check?

Your gut is telling you this is wrong, but your bills are telling you go ahead. Listen to your gut. This is bad and, if the other person has any claim of right to even a portion of that money, you could wind up charged with theft or some variant thereof.

Mr. Wagner is completely correct. Either get the consent of the other person or have the drafter reissue the check with a single payee.

The bank should not allow it to be deposited. Get the other person's signature or get a check with just your signature. Depending on what the check is for and why it has your name and the other person's name, you could face some problems if you don't obtain the appropriate signatures.
