Hi im really curious about the definition of exploiting in games. It seems so vague that gamers are unable to draw a clear distinct line between exploiting and simply using the game mechanics to maximise the performance of character. According to the EULA, You will not exploit any bug in Guild Wars 2 and you will not communicate the existence of any such exploitable bug bugs that grant the user unnatural or unintended benefits either directly or through public posting, to any other user of Guild Wars 2. There is this recent issue about thousands official statement being 4000 but doubt so of accounts PERMANENTLY banned 2days after the official launch, do note that they cost at least 55 usd. These acccounts got banned mainly because they purchase hundreds-thousands of items from an IN GAME vendor with apparently a bugged pricinga thousandth of its price. Is this exploiting of bug? Or simply maximising what was given to us.

Generally courts have followed a long standing precedent that the terms in a click-wrap license agreement will be upheld unless they are unconscionable (a very high standard, like if the Apple agreement had you agreeing to indentured servitude). Every case is different, but the likely outcome of your scenario is a court finding the agreement enforceable.
