Legal Question in Consumer Law in Florida

Jeweler Fraud?

I went to a jeweler to see if he would buy a diamond ring that I had. He looked at the ring and told be the best he could do was $1500. I'm in very bad financial shape right now so I told him that I really needed more and would have to think about it. He said I could get maybe $3500 if I sold it to a private party, but that would probably take a while. I thought about it for 48 hours and decided to take the $1500. I took the ring back to the jeweler, he looked at it again and then wrote me a check for $1500. I deposited it right away and paid the bills I had to pay. Several days later the jeweler starts calling me. When I finally am able to talk to him, he tells me the diamond isn't real and how dare I try to take advantage of him. I was totally shocked! I thought it was real and told him so but he kept saying I was trying to cheat him. I said, but you looked at it and said it was worth $1500, why would you say that if it wasn't? He said he looked at the two smaller stones and they were real but the center stone wasn't. My question is, am I liable here or is he trying to pull a fast one on me? He has had the ring for a week. He could have switched the stones. He's the expert not me. Legally, do I have to return the money?

Re: Jeweler Fraud?

If suit is commenced, the judge will determine liability and damages. In the meantime, were it I, I would not return the money.
