when is a sale a sale

My wife came home from work today and told me about a letter sent to her store from an attorney. It all started a couple of days ago at her jewlry store when a customer came in and inquired about some diamonds. One of the salesmen showed him one from a recient trip to Belgium.Unfortunatly it was labled wrong. The price on the tag was $4,000 when it was checked later it should have been marked $12,000 and they didnt find out untill right after the gentleman left. Here is where it gets tricky. The man put a $100.00 deposit on the diamond. Right after he left they checked the pricing and found there mistake, they immediatly called him and told him of the mistake. The man contacted an attorney and sent the letter to the store. My question is, can the man hold the store to sell something that whats mis-labled?
