Legal Question in Credit and Debt Law in Florida

Can I Be Arrested?

The Collections agencey I am dealing with has told me if I do not pay the amount they want me to pay that I could be arrested or do community service. I have never refused payment to them, but I can't afford what they are asking. Can I be arrested? And can I file a claim against them?

NO!

You can NEVER be arrested for not paying a debt. The only time you can be arrested for non payment of anything is if it is a court order for payment of child support. Even then, you are arrested for contempt of court rather than the non-payment.

I strongly suggest that you review the Fair Debt Credit Collection Practices Act which prohibits wrongful and abusive collection practices just like this.
