Legal Question in Credit and Debt Law in Florida

I have a brother I have not seen in 5 years. He has a debt collector who called me looking for him. (cursing and shouting between us both consumed the conversation). I have never been so poed in my life. What should I do?

Tell them to stop calling. You should also send them a letter, via fax or email, demanding that they stop calling you. Take notes of when they call and what they say; particularly if it's rude or unprofessional. If they don't stop, call us (813) 868-1989, they are violating the law.

It sounds as if the person calling (and his company) are violating the federal Fair Debt Collections Practices Act, and also violating the Florida Consumer Collection Practices Act. You should get the person's name and write down exactly the time of the call and what they say. If you request in writing that they stop contacting you, they should do so. If they continue to harass you, you may want to consider consulting with an attorney who's experienced in this area. Our office has handled a number of these claims and we offer a free initial consultaton. We would be happy to speak with you about the situation.
