Legal Question in Credit and Debt Law in Florida

capital one credit card debt

I was summoned to court by capital one for a $3,000 debt that has now turned into $5,000 accd'g to creditor due to atty feesa, late fees and interest. I tried to settle w/them before this goes to pretrial, but they refuse to accept 3,000! What can I do? Who can help me settle this debt, an atty? If it goes to court do they automatically place a judgemt. against me, even if I make an affordable pymt plan? I'm really upset, husband was laid off from his emplymt of 10 yrs, we are a family of 5 and we're struggling to make ends meet. Our children come first. Any suggestions?
