Forclosure

I am in Pre-foclusre. Papers serverd yesterday. My income is good but just not quite good enough to make payments with all other expenses. I would like to forclose but I am worried about deficiency judgment. Do I have to prove hardship to avoid judgement?

Does the mortgage company (countrywide) have the legal right, and do they pull a credit report on me?

Nothing avoids a deficiency judgment except the good graces of the bank. If they want a deficiency judgment against you, they can get one if they win the lawsuit. Hardship is irrelevant.
