Legal Question in Credit and Debt Law in Florida

I am a Realtor in Florida. I work as an independant contractor but I'm Associated with a brokerage company as required by law. The brokerage company recently received a Citation to Discover Assets from the City of Chicago attorney which requires the company to hold all payments to me until further order of court or termination of the proceedings. I have a commission check scheduled to be disbursed on or about 9/8. The company is required to submit documentation by 9/9 hearing.

How long can they keep a hold on my commission and how much of it are they entitled to take?

Thank you

Steve

They are checking the assets of the brokerage. Do you own an interest in it. If not, then there is no reason to hold your check. They should give you your percentage and then hold their percentage until the hearing. Contact the Attorney involved and double check with him as to this issue.
