Legal Question in Credit and Debt Law in Florida

Transferof payment liability

My grandmother was in a nursing home for a couple of months. When she got out she moved up north with my mother, and had my aunt sell her house. My aunt sold the house, and was supposed to pay the nursing home for my grandmother's stay. But my aunt neglected to do so. Now my grandmother has a lawsuit for collection for her stay at the center. Is it possible for a judge to tell my aunt to pay the money by assigning the verdict to my aunt instead of my grandmother? If not what can we do.

Re: Transferof payment liability

Your grandmother(or her guardian)should make a claim against your aunt for the moneys due. The court will not automatically tranfer a verdict. Good luck.

The fact that a lawsuit has been filed does not mean you cannot reach a settlement (maybe for a little less even). Has your grandmother been served with the lawsuit?

If she has been served legally, that is, she was served where she resides (outside FL?) and according to that state's law, then contact opposing counsel and ask for payment plan or have you aunt make the payments now.

The nursing home does not want to deal with attorneys' fees.

Good luck
