Legal Question in Criminal Law in Florida

My boyfriend just got arrested for bogus drug charges. His mom wants to let him stay with a public defender but I think that he needs a paid lawyer because he is innocent. She said he;ll only get probation since its his first time offense but he has been arrested on 3 felonies and 1 mis - how do I find out the Florida state "Point" system?

Unfortunately, since he's had prior Felonies, your boyfriend may not receive the 1st time offender treatment. Depending on whether or not he was convicted on those charges, it may effect his score sheet. As far as staying with the public defender; in general the public defender's office has great attorneys. However, often because of budget constraints, many public defenders are overloaded with case loads that can sometime reach a few hundred cases. This leads to the attorney not having the time to provide clients with personal service and answer their questions. Unfortunately, this may be a case with a private attorney as well. If you do seek a private attorney, be sure to inquire about their case load and their ability to provide the assistance you seek.
