Legal Question in Criminal Law in Florida

Car Lease/Impound

My brother totaled his leased car in a

felony. His car is in impound at $25

day. He will not be able to continue

paying the lease since he was

without a job and now in jail. What

do we do with the car? Should we

notify the leasing company to take

the car back? Can he relinquish

rights so that the impound can allow

the leasing company to repossess the

car? My insurance policy indicates

that it will not pay for damages that

occur in a felony or intentionally

done--is that the case on all policies?

Re: Car Lease/Impound

I would probably notify the insurance company about the accident, at the same time I would request a copy of the actual policy.

At this time he has not been convicted of a crime, only charged. Maybe something can be done on the criminal case to ensure that he doesn't get convicted or gets the case dismissed.

With a copy of the policy and the police report I could give you a much better answer.

My office is here in Broward where I used to work as a prosecutor, give me a ring and we can discuss further.

Good luck,
