i have been charged theft for finding a school walky talky on school parking lot and there charging me with theft because i dident report it or give it to the school i also made a few calls on it messing around with the school security i want to no can i go to jail or anything because of this

If the value of the walky talky is less than a hundred dollars, then you are charged with a second degree misdemeanor, punishable by up to 60 days in the county jail. If the value of the walky talk is between 100 and 300 hundred dollars, then you are looking at a first degree felony punishable by 365 days in the county jail.

This is not to say you WILL get these punishments, just that these are the maximum allowable punishments by Florida Law. A criminal attorney needs to review the specific facts of your case to explain what punishment you would be looking at if you pled guilty. However, you may also choose to fight the charge.
