Criminal or Victim??

My son was under pti program (poss of cocaine), he is also Bi-polar manic. His ''Psych'' had him on meds that were causing confusion, mood changes, hallucinations, and mild agressiveness. The ''Psych'' was notified about this problem yet continued to give these meds. My son went to bed here at home and woke up in jail. Charged with burglary, and crim. mischief. Police said he broke some clay pots and was found in a screen room sleeping in a lounge chair just down the street from our home, yet he remembers none of this. Does not remember Police asking him questions, and according to police could not tell them why he was at these 2 mobil homes in our park. Currently he is in the medical unit of the jail. How likely is it that the State Atty will file formal charges for burglary/criminal mischief. and that he will go to prison. and can any action be taken against this ''Psych''. I am under disability and can't afford Bail nor an Atty for him. His PD has done nothing for 3 wks but said if they charge him he will go to prison. I gave RX pamphlets which shows side affects that my son displayed. My son is not a ''criminal'' he is Bi-polar manic recovering from drug addiction. Never arrested prior to possession charges and he is 26.

I am sorry to hear your sad situation. His defense attorney would have to hire an expert pharmacologist and psychiatrist to investigate your claims and present evidence to the jury. Your claim is more a mitigator than an outright defense. The psychiatrist is not liable for anything really.
