Domestic Battery

This is my first arrest. What is the best way to get out of this charge? I don't want to go to jail. I have a 7 month old baby. Is this a serious charge? I don't know anything about the legal system in Florida.

This is considered a very serious charge. The fact that you have a seven month old baby does not work to your advantage. The court does not deem you to have the right to batter your spouse and there is no way "to get out of it".

If you have a good attorney, you may be able to get placed in an anger management program and avoid a criminal record depending on the extent of the injuries, if any, and your spouse's decision to prosecute or not. You should get a competent criminal attorney to represent you in this matter as a conviction can affect you the rest of your life.
