Legal Question in Criminal Law in Florida

A person was passed out from drinking, going in/out of consciousness and her boyfriend placed in a running vehicle on the passenager side. The vehicle hit a mobile home.....the person was taken out of the passenager side of the vehicle.....the boyfriend states she reached across to lock the door and hit the gear shift causing the car to go forward and hit the home. This person who is passed out in a home, taken and placed in a running vehilce, has no knowledge of what happen. Is there any type of defense for this type of situation? Law enforcement states if she touched the gear she was in controll of the vehilce.
