Habitual Felony Offender

On March, 2005 I was sentenced to 6 months county jail followed by two years community control. I was deemeed a ''habitual felony offender''. I have since then completed my jail time and terminated my community control.

I was re-arrested on on April of 2006, for something that happened in April of 2004. Since the crime they are currently accusing me of was allegedly committed on April 2004 (one year before they named me a ''habitual felony offender'') will they judge me on this new charge as such?? (a habitual felony offender?) or would they crime have to have been committed AFTER May 2005, which is when they imposed that ''habitual felony offender'' sentence on me.

I'm very worried since I have a great job now and my life has been on track since May of 2005 which is when I was released from jail.

Habitual felony offender allows the judge to give you more prison time. It sounds like although you were declared a hfp you did not receive the punishment for it. The new charge which happened earlier in time will not be affected by the recent habitualization. you will be habitualized only if you qualify from that charge and your record.
