Legal Question in Criminal Law in Florida

My husband lost his .25 pistol at the gun rage a few weeks back.Later he found it in the trunk of his car and put it in an unused purse of mine also in the trunk to prevent our kids from seeing it as he brought it back into the house. Unknowingly I find a purse that I've been lookin for and pick it up on the way to accompany my husband to the courthouse for a traffic ticket.That's when I was arrested.

What is your question? I think that defense, while perhaps true, would be difficult for a judge or jury to believe.

I presume you are checking to see if we believe your story, with the idea that if we believe it you can sell it to a jury. The problem is that the state doesn't need to prove specific intent to convict you of the crime, so your defense, and no it is not very credible, is not going to work. Good luck trying to convince any woman or any man who has ever been around a woman that you just picked up a purse without checking its contents, such as your wallet, keys, or makeup. Best bet is to check with the state through your attorney and look for a diversion program to ultimately see if case can be dismissed. Also good luck convincing any one that a gun that was lost at a gun range mysteriously ended up in your trunk, and then in your purse. Especially a .25 which is normally a womans gun to start with. Next time pay attention to what you are doing.
