Legal Question in Criminal Law in Florida

miranda warning

My friend waived his rights and signed a Miranda warning. They were taping him signing the miranda warning. We have a copy of the video, but the police department lost the signed warning. Does this help us in any way? I mean, technically, no one can proved what he signed.

Re: miranda warning

well to use any statement against him they must prove that miranda was given, and this means submitting the signed form into evidence. if they lost this form, then they could enter the video so long as it is clear that the warnings were given properly and the defendant clearly waived these rights most courts would accept that as proof.
