Legal Question in Criminal Law in Florida

Misdemeanor - Please help

My uncle was in the states visiting was charged in March 05' with a misdemeanor while fishing dolphins less then 20in. He had to travel back to his country and miss the court date, he has been unable to return to the states to clear his case due to his expired visa. He would like to clear things here but we do not know how to go about the situation. Please advise.

I would need to know more to give you a better answer. For instance what country issued the visa? and is it expired due to this offence?

Depending on the above info what you should do is contact an attorney and have the attorney speak with the Judge and schedule an in-court surrender for the warrant that was issued when he failed to appear.

At the surrender hearing the judge would most likely issue a bond, release him outright, or the attorney could negotiate a plea before he gets there and it could be resolved on that date.

Feel free to give me a ring if you would like to discuss further; my office is here in Broward.

My office would be able to handle the matter. What I would need from your uncle is an executed affidavit to represent him in absentia. In other words, I will be able to represent him without him having to be present. Please contact me at my office to further discuss.
