Legal Question in Criminal Law in Florida

My niece was just arrested in Panama City Beach on spring break. She is 21. She agreed to let them search her car which they found one gram of marijuana. SHe had alcohol in the trunk and 19 and 20 year old girls in the car. They let the other girls go, dumped out the alchol and charged my niece with possession and she can't get out til tomorrow. If it is a misdemeanor then why did they put her in jail. Also should she have submitted to the search or asked for a warrant.

She is facing up to a year in jail and a one year license suspension. She probably should not have consented, but it's too late for that now (although for the future NEVER consent). For now, she needs to get an attorney in the Panama city area so that she can avoid some of those serious consequences.
