Legal Question in Criminal Law in Florida

Penal Code section 632

Are the statutes set forth in this law applicable in other states? In other words, is it illegal to secretly tape conversations in any state and/or is that tape be admissible in court in any state (Florida, in particular)?

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

You gave very few facts upon which to frame an answer. Generally either state's laws might be invoked and accepted by a court. Florida would not allow a conversation that was secretly taped to be admitted into court as evidence. As to other states laws, you can look at this site for some guidance and insight:

There is a wealth of information located there and you should review it carefully. Perhaps that will better answer your question.
