if a person is taken to trial on a third degree fel.,and is found guilty of the lesser .can they be sentenced on a third degree fel?
It would depend on what you mean by lessor. There are levels to felonies which really go towards the point total on the score sheet and there and misdemeanor lessors. Typically, people referring to a lessor would mean a degree of felony down or down to a misdemeanor. However, a person could be charged with F3 level 4 burglary of conveyance alone but someone asks to include "lessor" F3 level 2 grand theft. This is not common as those charges can and usually are already filed and presented to the jury, but it could happen.
