Petit Theft

My freind FOUND a cellphone in a wallmart store.He placed 1 call to his home for advice he was told to turn it in to lost and found which he did.Long story short police contacted him latter for questioning and now he is facing petit theft charges.He through the police investigator offered to pay for cellphone even though there was only 1 call placed owner refused compensation and wanted to press charges.Freind has no criminal record and doesnt wish to have one.how can he be charged with theft if no phsycal theft takes place and he offered restitution.he has already been summonsed to appear in court.is there any way out of this for him?

Re: Petit Theft

Petit theft means possesion with intent to deprive use by the owner. No taking or theft needs to take place. He can take the case to trial and explain the circumstances. They might let him go.
