Legal Question in Criminal Law in Florida

Public Defender - can i trust what he says?

I have FELONY charge (Grand theft)- I have been offered PTI (comm svce + class = Dismissed). PD has told me case can't be reduced to MISD because I am a co-defendant with an x-

byfrd who was sentenced to 5 Yrs last month. Is it possible to be Co-Def with a case that is already done? I am afraid to take to trial because I cannot prove I didn't know what was happening until after the fact. (b-frnd going to job writting himself checks, when he had my car he had key to office on key ring). PD has also told me case can be expunged when dismissed - do i have to wait 10 yrs or can it be done immediately( I read another question said it could be sealed and 10yrs later expunged). I was also told by PD Grand Theft can be expunged (only violent charges cannot) Before I take PTI I'm trying to find out my options

or if I should chance it and take it to Trial. This has been going on since Apr 04 and I have NEVER received a call back from PD luckily I have been determined to get him on the phone by harrassing his office and have spoken to him 2 X's.

The Public Defender's Office in Palm Beach County is a great office. However, many PD's are very overworked.
