Legal Question in Criminal Law in Florida

I recently submitted documentation to the Marco Island Police Department regarding an unauthorized credit card charge on my credit card. I was told because the funds were returned to me it was not a criminal matter. I could, however, continue the matter in Collier County Civil Court. I am unsure who decided this was not a criminal case; may I seek further advice through the State Attorney's Office on whether or not my situation is criminal or civil?

Certainly you could, but the State Attorney's Office will first need to determine that a criminal law was violated. Furthermore, they need to decide if they can prove it beyond a reasonable doubt. In other words, it can't hurt to ask them and even if they don't prosecute, you know you can do something civilly.
