Is a deposition legal when there is no subpoema sent to a witness?

A deposition is "compelled testimony" under oath. If they did not serve the subpoena on you, they can not compel you to talk. However, if you still go or participate in the deposition even without being served the subpoena, they can still use the deposition against you.
