How can I dismiss this charge after overpayment of $1,259 has been paid; before initial hearing is set by state attorney. Hearing will be set approx. 2-3 weeks from now. I was on medication during unempl.

Prepayment of the overpayment isn't going to get the charge dismissed automatically, though some State Attorney's Offices will dismiss the charges if the overpayment is paid before arraignment. You'll have to ask them.
If the State Attorney's Office won't drop the charges, and this is your first offense, you should speak to them about diversion, which will cost you a little more, but will also allow the charge to be dismissed.
