Legal Question in Criminal Law in Florida

VOP Sentence

My fiance is currently incarcerated on a VOP warrent. The VOP was on charges of possestion w/intent to sell. He has been detained for 4months and was just offered 2yrs by his PD secretary. My fiance has been a model citizen by holding a job for 2yrs, supporting a family. What can I do?

There is nothing you can do. Your husband can take the deal or fight the vop.

I saw you already have an answer, but want to give you a contact in North Fla. should you need it. Your question is kind of hard to give a simple answer to. You don't state what the violation is. Do you think the P.D. is investigating the violation well enough and negotiating with the State agressively enough?

As the other lawyer stated, his choice may be to go to a hearing or enter a negotiated plea. I don't know where this case is or who the Judge is, but up here, at times, we decline the State's offer and plead directly to the Court...without an agreed sentence. In other words...the so called "mercy of the Court". Sometimes the Judge will undercut the State and give a more favorable sentence. This is risky. You need to know the Judge and his/her tendencies.
