Is There a specific formula needed to present your dollar setelment amount when you are meadeating.

If you are represented by legal counsel these are issues you should discuss with that person. That said, you can start by calculating lost wages from the date of termination until the date of settlement. You should deduct any monies earned during this time, but not unemployment compensation recieved. Add in the value of lost benefits such as the company share of insurance while you were employed and what the company would have contributed to any 401k or retirement plan. If this is an age case liquidated damages equal to the damages are available should this go to trial. If this is a race or gender case punitive damages may be available depending on the facts, in amounts that depend on the number of employees the company had. In mediation it is normal to accept an amount certain that is less than full relief today, inorder to avoid the stress, costs, time and uncertainty of litigation that could take a considerable amount time to reach a conclusion.
