2nd dui no maranda

i was pulled over 2 blocks from home the other nite after a couple glasses of wine. i tried to take the breath test, but have a severe chest cold and didnt preform well enough, according to the male officer ''i didnt know how to blow'' i was pulled over before 4am, got to county jail after 8am, and was never read my rights, do i have any recourse? and im not mentioning the rest of the degrateing things the officers said
