Many Judges give great weight to the wishes of the prosecutor when determining what plea bargain to offer or accept. Other Judges don't care, and "make the offers". If a prosecutor does not have a recommendation, he is leaving the plea bargaining between the criminal attorney and the judge.

Remember, DUI charges have minimum penalties and fines if you chose to resolve your case via plea bargain.
