Legal Question in Elder Law in Florida

newly widowed. need help with husband's pension

my husband and I were in the process of paperwork to change his pension. he was in a rehab facility and unable to put pressure on his foot so I went to a notary who reassured me he did not need to be present to sign papers because I had Power of Attorney papers. After notarizing the documents they were sent in to the Company. I received notification dated 2 days after my husband died denying our claim saying he needed to sign them.

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

If you had a valid Power of Attorney, and the instrument was properly executed in the presence of a notary, then it should be valid. You need to consult an attorney to review the paperwork including the papers you signed and the denial letter. It appears that you may have to hire the attorney to represent you in getting this matter resolved.
