Logo Copyright

I'm musician in a band. About 8 months ago our former band member had a friend design a logo for us. We've used this logo free uf charge for the last 8 months as the designer made the logo free of charge for us (as a friendly gesture to his buddy) We decided to get rid of this member in the band and now he has written us saying that his friend will be writing us a cease and desist letter because we own him a copyright payment for the logo. Is there a certain statue of limitations on graphic arts. We've been using this logo for some time with this individual's knowledge, under the pretences that it was designed as a friendly guesture for our former member? Our former member is clearly trying to sabatoge the band for spite. Thanks for your help.

You can argue about this issue or simply start using a different logo. You might not need to change it much.
