Legal Question in Family Law in Florida

I have 2 minor children (10 & 9) & currently live in Florida. My ex-husband lives in Michigan & does not pay child support, even though we have an order he has only paid $300.00 since 9/2009 & he does not have visitation rights. My current husband would like to adopt them but me ex will not agree. Are there any other options I have for him to either adopt them or make him a legal guardian?

You would have to petition the court to terminate the biological father's rights. This is very difficult to accomplish without very good reasons. failure to pay child support is normally not enough grounds for a court.

Your current husband cannot adopt your children without the father's consent.

Have you considered taking your ex back to court for failure to pay child support?
