Adoption

My stepchildrens mother has passed away and we need to know if should my husband pass away will his children automatically be given to me as a stepparent or should I adopt them?

Unless you adopt the child, you have little, if any, legal standing to adopt the child if your husband dies. You are not related by blood or any other legal tie.

If you feel strongly about the child, you should speak with your husband about a step-parent adoption. The process is relatively easy but an attorney will be almost mandatory. The cost is minimal for the peace of mind it will bring.
