Legal Question in Family Law in Florida

I need some advice

I want to extend the age at which my son can leave the state with his father. My son has not seen him for over 2 years and I want him to visit with him here before he goes all the way to MO. I just don't think my son will take it very well cause he won't even talk to him on the phone. And this has been going on for a few months now, about 5.

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

Without knowing the specifics of your case or the court order, it is hard to provide information to you. Regardless, in order to change anything, you will need to go back to court and file a motion to modify the court order setting forth the out of state visitation. Be prepared for a tough battle, however. The court will generally not do it just because you say so. Verifiable proof of non visitation coupled with credible testimony of the danger or harm of the out of state visitation by an expert may be required.
